התנאים האלה חלים על השימוש באתר trail-blazer.live ובשירות Trail Blazer: מפות המירוץ, דפי המשתתפים, ההרשמה, עמדת השליטה למארגנים, מסך החדשות במפה ובוט הטלגרם. השימוש באתר מהווה הסכמה לתנאים. מי שלא מסכימים להם, מתבקשים לא להשתמש בשירות.
חשוב: המעקב במפה נועד לצפייה ולתוצאות. הוא לא מערכת בטיחות, ניטור או חילוץ, והמיקום בו יכול להתעכב או להיעדר.
1מי אנחנו והגדרות
השירות מופעל על ידי [שם העסק או החברה], [מספר חברה / עוסק], [כתובת מלאה] ("אנחנו").
- מארגנים: מי שמקימים ומנהלים אירוע במערכת, וצוות הניהול שהם מזמינים (שופטים, צוות שטח).
- משתתפים: מי שנרשמים לאירוע או נרשמים בו על ידי אחרים, ומיקומם מוצג במפה.
- צופים: כל מי שנכנסים למפה, לדף משתתף או לאתר.
התנאים כתובים בלשון רבים ומתייחסים לכל המגדרים.
2חשבונות משתמשים
- חשבון נפתח בהזמנה. הפרטים בו צריכים להיות נכונים ועדכניים.
- הסיסמה אישית. אין למסור אותה לאחרים. על חשד לשימוש לא מורשה מודיעים לנו מיד.
- מארגנים אחראים למי שהם מזמינים ולהרשאות שהם נותנים, ולכל מה שנעשה בחשבונות האלה.
3אחריות המארגנים
- המארגנים הם האחראים על האירוע עצמו: התקנון, הצהרת הבריאות, ביטוח, היתרים, בטיחות המשתתפים, גביית תשלום והחזרים.
- המארגנים אחראים ליידע את המשתתפים שמיקומם יוצג בפומבי, ולקבל את ההסכמות הנדרשות לפי החוק במדינה שבה מתקיים האירוע.
- המארגנים מעלים רק מסלולים, תמונות ותכנים שיש להם זכות להשתמש בהם.
- תנאים מסחריים (מחיר, היקף שירות, תמיכה) נקבעים בהסכם נפרד עם כל מארגן: [לפי הצעת מחיר / הסכם התקשרות]. אם יש סתירה, ההסכם הנפרד גובר.
- לבקשת מארגנים נחתום על הסכם עיבוד נתונים (DPA) שמתאים ל-GDPR.
4משתתפים
- הפרטים שמוסרים בהרשמה צריכים להיות נכונים. מי שרושמים צוות מאשרים שהם רשאים למסור את פרטי חברי הצוות, ושחברי הצוות מסכימים לכך.
- בהרשמה מאשרים שמיקום ה־GPS, המסלול, הזמנים והדירוג יוצגו בפומבי על מפת המירוץ, כמו שמתואר במדיניות הפרטיות.
- ההרשמה היא לאירוע של המארגנים, והתקנון שלהם חל עליה. שאלות על תשלום, ביטול והחזר מפנים למארגנים.
5שימוש מותר
אסור:
- לעקוב אחרי אדם בלי ידיעתו או הסכמתו, או להשתמש במיקום של משתתף כדי להטריד, לאיים או לפגוע.
- להעלות תוכן לא חוקי, פוגעני, מטעה, או כזה שפוגע בזכויות של אחרים (כולל צילומים של אנשים בלי רשותם במקום שזה נדרש).
- לאסוף מידע מהאתר בכמויות באופן אוטומטי, לנסות לעקוף הרשאות, לפגוע בשרתים או להעמיס עליהם.
- להתחזות לאחרים או להשתמש בשירות בניגוד לחוק.
נוכל להסתיר תוכן, להשעות חשבון או לחסום גישה כשיש חשד סביר להפרה.
6תכנים שמעלים
תמונות, לוגואים, מסלולים, טקסטים וסרטונים שמעלים לאתר או שולחים לבוט נשארים של מי שהעלו אותם. ההעלאה נותנת לנו ולמארגני האירוע רשות לא בלעדית, ללא תמורה, להציג אותם במפה, בדפי המשתתפים, במסך החדשות ובתוצאות של האירוע, ולשמור אותם לפי מדיניות הפרטיות. מי שמעלים מאשרים שיש להם זכות לעשות זאת. אפשר לבקש מאיתנו או מהמארגנים להסיר תוכן.
7קניין רוחני
האתר, הקוד, העיצוב, הלוגו, הציורים והשם Trail Blazer שייכים לנו או למי שהעניקו לנו רשות. אין להעתיק, למכור או להשתמש בהם בלי אישור בכתב, מלבד צפייה ושיתוף קישורים רגילים. רקעי המפה שייכים לספקים שלהם (למשל OpenStreetMap) ומוצגים לפי הרישיונות שלהם.
8שירותים ומכשירים של אחרים
השירות עובד עם מכשירי מעקב, אפליקציות, Telegram, ספקי מפות ושירותים נוספים של חברות אחרות. אנחנו לא אחראים לזמינות, לדיוק או לתנאים שלהם, והשימוש בהם כפוף לתנאים שלהם.
9זמינות ושינויים בשירות
- אנחנו עושים מאמץ שהשירות יעבוד ברציפות, במיוחד בזמן אירועים, אבל לא מתחייבים שיעבוד תמיד בלי תקלות, עיכובים או הפסקות.
- מיקום, מרחקים, זמנים ודירוג מחושבים מהנתונים שמגיעים מהמכשירים, ויכולים להיות לא מדויקים. התוצאות הרשמיות הן אלה שהמארגנים מאשרים.
- מותר לנו לשפר, לשנות או להפסיק חלקים מהשירות. על שינוי מהותי שמשפיע על אירוע קרוב נודיע למארגנים מראש ככל האפשר.
10הגבלת אחריות
- השירות ניתן כמו שהוא (AS IS). ככל שהחוק מתיר, אנחנו לא אחראים לנזק עקיף או תוצאתי, לאובדן רווחים, או לנזק שנובע מהסתמכות על מיקום, זמנים או דירוג.
- אנחנו לא אחראים לבטיחות המשתתפים, לניהול האירוע או להחלטות של המארגנים.
- ככל שהחוק מתיר, האחריות הכוללת שלנו כלפי מארגן מוגבלת לסכום ששולם לנו עבור האירוע הרלוונטי, וכלפי משתתפים וצופים שלא שילמו לנו מוגבלת ל-[100 ₪].
- שום דבר בתנאים לא מגביל אחריות שאי אפשר להגביל לפי החוק, ולא פוגע בזכויות שחוקי הגנת הצרכן נותנים.
11שיפוי
מארגנים ומשתמשים שמפרים את התנאים או את החוק ישפו אותנו על נזק והוצאות סבירות (כולל שכר טרחת עורכי דין) שנגרמו לנו בגלל ההפרה, אחרי שנודיע להם ונאפשר להם להתגונן.
12סיום השימוש
אפשר להפסיק להשתמש בשירות בכל עת ולבקש למחוק חשבון. אנחנו רשאים לסגור חשבון שמפר את התנאים. אחרי סגירה, המידע נמחק או נשמר לפי מדיניות הפרטיות.
13דין וסמכות שיפוט
על התנאים חלים דיני מדינת ישראל. הסמכות הבלעדית נתונה לבתי המשפט המוסמכים ב[תל אביב-יפו]. משתמשים צרכנים מחוץ לישראל שומרים על ההגנות שהחוק במדינה שלהם נותן ושאי אפשר לוותר עליהן.
14שינויים בתנאים
אם נשנה את התנאים נעדכן את התאריך בראש הדף, ועל שינוי מהותי נודיע למשתמשים הרשומים. המשך השימוש אחרי השינוי מהווה הסכמה לתנאים החדשים.

These terms apply to the website trail-blazer.live and the Trail Blazer service: the race maps, participant pages, registration, the organizers' control room, the news screen on the map and the Telegram bot. By using the site you agree to these terms. If you don't agree, please don't use the service.
Important: tracking on the map is for following the race and for results. It is not a safety, monitoring or rescue system, and the location on it can be delayed or missing.
1Who we are and definitions
The service is operated by [Company or business name], [company / business number], [full address] ("we", "us").
- Organizers: those who set up and run an event in the system, and the admin staff they invite (judges, field crew).
- Participants: those who register for an event or are registered by others, and whose location is shown on the map.
- Viewers: anyone who opens the map, a participant page or the website.
2User accounts
- Accounts are opened by invitation. The details in them must be correct and up to date.
- Your password is personal. Don't share it. Tell us straight away if you suspect someone else is using your account.
- Organizers are responsible for the people they invite, the permissions they give, and everything done with those accounts.
3Organizers' responsibilities
- Organizers are responsible for the event itself: race rules, health declaration, insurance, permits, participant safety, collecting payments and refunds.
- Organizers are responsible for telling participants that their location will be shown publicly, and for getting the consents the law requires in the country where the event takes place.
- Organizers upload only routes, photos and content they have the right to use.
- Commercial terms (price, scope, support) are set in a separate agreement with each organizer: [per quote / service agreement]. If they conflict, the separate agreement wins.
- On request we will sign a GDPR-compliant data processing agreement (DPA) with organizers.
4Participants
- Registration details must be correct. If you register a team, you confirm that you may provide your team members' details and that they agree.
- At registration you confirm that your GPS location, track, times and ranking will be shown publicly on the race map, as described in the privacy policy.
- You register for the organizers' event, and their race rules apply. Questions about payment, cancellations and refunds go to the organizers.
5Acceptable use
You must not:
- Track a person without their knowledge or consent, or use a participant's location to harass, threaten or harm anyone.
- Upload content that is illegal, offensive, misleading, or infringes other people's rights (including photos of people without their permission where that is required).
- Scrape the site, try to get around permissions, attack or overload the servers.
- Impersonate others or use the service against the law.
We may hide content, suspend an account or block access when we reasonably suspect a breach.
6Content you upload
Photos, logos, routes, text and videos you upload to the site or send to the bot stay yours. By uploading them you give us and the event organizers a non-exclusive, royalty-free permission to show them on the map, participant pages, the news screen and the event results, and to keep them as described in the privacy policy. You confirm you have the right to upload them. You can ask us or the organizers to remove content.
7Intellectual property
The site, code, design, logo, paintings and the Trail Blazer name belong to us or to those who licensed them to us. Don't copy, sell or use them without written permission, apart from normal viewing and sharing links. Map backgrounds belong to their providers (for example OpenStreetMap) and are shown under their licences.
8Other companies' services and devices
The service works with tracking devices, apps, Telegram, map providers and other services run by other companies. We are not responsible for their availability, accuracy or terms, and using them is subject to their own terms.
9Availability and changes
- We work to keep the service running, especially during events, but we don't promise it will always work without faults, delays or interruptions.
- Location, distances, times and rankings are calculated from the data the devices send, and can be inaccurate. The official results are the ones the organizers approve.
- We may improve, change or stop parts of the service. We will tell organizers about any significant change that affects an upcoming event as early as we can.
10Limitation of liability
- The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential damage, lost profits, or damage caused by relying on location, times or rankings.
- We are not responsible for participants' safety, for running the event, or for the organizers' decisions.
- To the extent the law allows, our total liability to an organizer is limited to the amount paid to us for the event in question, and to participants and viewers who did not pay us to [ILS 100].
- Nothing in these terms limits liability that cannot be limited by law, or affects your statutory consumer rights.
11Indemnity
Organizers and users who breach these terms or the law will cover the damage and reasonable costs (including legal fees) we suffer because of the breach, after we notify them and let them defend themselves.
12Ending use
You can stop using the service at any time and ask us to delete your account. We may close an account that breaches these terms. After closing, data is deleted or kept as described in the privacy policy.
13Governing law and jurisdiction
These terms are governed by the laws of the State of Israel. The competent courts in [Tel Aviv-Jaffa] have exclusive jurisdiction. Consumers outside Israel keep the protections their local law gives them that cannot be waived.
14Changes to these terms
If we change these terms we will update the date at the top of the page and tell registered users about any significant change. Using the service after a change means you accept the new terms.
